David A. Jagolinzer is a partner and shareholder of The Ferraro Law Firm and specializes in complex cases that involve mesothelioma victims, product liability, asbestos litigation, toxic torts, serious injury and wrongful death. Mr. Jagolinzer has been successful in obtaining millions of dollars for thousands of the Firm's clients both in trials and in pretrial settlements. Most recently in 2008, Mr. Jagolinzer was selected in 2008 by the DBR as Finalist for Most Effective Lawyer in Product Liability cases.

Some of Mr. Jagolinzer's recent and most notable jury verdicts and trial settlements for victims include the following cases where landmark legal issues were involved:

Over $2 million settlement - Debie v. American Standard, Inc., January, 2009. Mr. Debie was an 80 year old over repairman suffering from pleural mesothelioma.

$24.2 million jury verdict - Guilder v. Honeywell International, Inc., April 2008. Dr. Guilder was a 51 year old Weston doctor suffering from peritoneal mesothelioma. This is the highest compensatory damage award against a single defendant in a mesothelioma case to date.

Over $14 million settlement - Plaintiff v. Union Carbide Corporation, August, 2008. The plaintiff was a 61 year old drywall contractor suffering from pleural mesothelioma.

Over $2 million settlement - Nicolella v. Bondex International, Inc., October, 2007. Mr. Nicolella was an 85 year old painter suffering from pleural mesothelioma.

Over $5 million settlement - Parsons v. Ford Motor Company, et al., February, 2007. Mr. Parsons was a single, 69 year old automotive mechanic suffering from peritoneal mesothelioma.

$1.8 million jury verdict - Lagueux vs. Union Carbide Corporation, 861 So.2d 87 (Fla. 4th DCA 2003). Mr. Lagueux was a drywall finisher suffering with asbestosis and this was the first case in the nation in which a jury awarded damages against Union Carbide in connection with the asbestos it mined.

$1.2 million jury verdict - Kavanaugh vs. Union Carbide Corporation, 879 So.2d 42 (Fla. 4th DCA 2004). Mr. Kavanaugh was a carpenter suffering from peritoneal mesothelioma and this was Mr. Jagolinzer's second consecutive victory against Union Carbide and solidified the legal responsibility in Florida against companies such as Union Carbide who had previously claimed legal immunity as bulk suppliers of raw materials.

$2 million jury verdict - Zimmerman vs. ACandS, Inc., 823 So.2d 785 (Fla. 4th DCA 2002). Mr. Zimmerman was an electrician suffering from pleural mesothelioma and this case solidified the legal responsibility in Florida of companies that negligently re-branded and installed asbestos products.

In addition to verdicts at the trial court level Mr. Jagolinzer has also successfully argued and won major victories for the Firm's clients in appellate courts. Mr. Jagolinzer's most recent appellate victory is in Daniel N. Williams, et al. v. American Optical Corp. et. al. , 985 So.2d 23 (Fla.4th DCA 2008) where the 4th District Court of Appeals struck down and found unconstitutional Florida's Asbestos Statute which limited victims' ability to seek compensation for their injuries.

Other significant appellate victories include: Elizabeth McConnell v. Union Carbide Corporation, No. 4D04-4329 (4th DCA 2006); Fox v. Union Carbide Corporation, 910 So.2d 422 (Fla. 4th DCA 2005); Sanders v. Union Carbide Corporation, 2005 WL 2373875 (Fla. 4th DCA 2005); Bradley v. Union Carbide Corporation, 2005 WL 2654588 (Fla. 4th DCA 2005); Shamburger v. Union Carbide Corporation, 2005 WL 2654377 (Fla. 4th DCA 2005) Bosarge v. American Optical Corporation (Fla. 4th DCA 2005).

A 1999 graduate of the University of Miami School of Law, Mr. Jagolinzer is admitted to The Florida, Massachusetts and District of Columbia Bars and actively litigates cases throughout the nation. Mr. Jagolinzer is a member of the American Bar Association, Florida Bar Association, Massachusetts Bar Association, Dade County Bar Association, Broward County Bar Association, American Association for Justice, the National Italian American Bar Association and the Million Dollar Advocates Forum. Mr. Jagolinzer also plays an active role on creditor's committees relating to bankruptcy filings of asbestos companies, serves as an arbitrator for alternative dispute resolution programs, and has been active in representing victims' rights in front of the Florida Legislature. He is also a frequent lecturer on litigation and trial preparation skills for other attorneys. Mr. Jagolinzer also speaks fluent Italian.
