The Ferraro Law Firm, P.A., successfully fulfilled their promise to their clients and all Floridians to fight against “Florida’s Asbestos and Silica Compensation Fairness Act”. July 8, 2011, the Florida Supreme Court justly said Florida’s asbestos litigation reform act violates the constitutional rights of Floridians injured by asbestos products in the case American Optical Corp. et al. v. Spiewak et al.

Upon learning of the asbestos industry’s proposed legislation, The Ferraro Law Firm, P.A., promised their clients and all Floridians to fight against this measure. Jim Ferraro and David Jagolinzer personally traveled to Tallahassee to argue to the legislature the unconstitutionality of dismissing injured Floridians’ lawsuits at the behest of out-of-state asbestos product manufactures. After six long years, The Florida Supreme Court finally agreed and declared it was unconstitutional for the legislature to pass a law that destroyed these vested rights by dismissing Floridians’ lawsuits mid-litigation, and in some case right before trial was set to commence.

Asbestos is a well-known deadly, cancer causing product, and the only people in the world who dispute this long-established fact are paid, asbestos-product industry consultants. As a consequence of asbestos product manufacturers concealing the dangers of their products, thousands upon thousands of Floridians were unknowingly and unnecessarily injured or killed by inhaling asbestos from these manufacturers’ products.

Rather than fairly compensate Floridians injured by their asbestos-products, out-of-state asbestos product manufactures spent millions lobbying the Florida legislature in 2005 to pass a law that would dismiss thousands of asbestos lawsuits filed against them in and around Florida. The text of the Act, ironically named, “Florida’s Asbestos and Silica Compensation Fairness Act”, was drafted by asbestos industry lawyers and lobbyists, and was hastily enacted by the Florida legislature in 2005 without debate or investigation.
